Kodak Professional InkJet Photo Paper Black & White Photo Contest
OFFICIAL CONTEST RULES

- ELIGIBILITY: The Kodak Professional Inkjet Photo Paper B&W Photography Contest (the “Contest”) is open only to legal residents of the fifty United States (including DC) 18 years of age or older. All employees of Eastman Kodak Company, Hachette Filipacchi Media U.S., Inc. (the "Sponsors"), and their respective parent companies, subsidiaries, affiliates, sales representatives, distributors, manufacturers, licensees or agents and their immediate family members and those living in the same household of each, are not eligible to participate in this Contest. Photographers who derive 5% or more of their income from taking photographs are ineligible. All applicable federal, state, municipal, and local laws and regulations apply. Void where prohibited.
- CONTEST PERIOD:The Contest runs between 12:00 a.m. Eastern Time (“ET”) on June 20, 2006 and 11:59 pm ET on September 30, 2006 (the “Contest Period”).American PHOTO Magazine’s computer is the official time keeping device for the Contest.
- HOW TO ENTER:Submit a black and white image printed on KODAK PROFESSIONAL Inkjet Photo Paper.Only images printed on KODAK PROFESSIONAL inkjet photo paper will be accepted.Submit your print with your name, complete address including ZIP code, daytime phone number with area code, e-mail address (if available), and state where photograph was taken, and whether the picture was captured on film or with a digital camera (collectively, “Entry information”).The photograph and entry information must be firmly attached to each other. To submit your entry: Mail your submission to American PHOTO Magazine, Attn:KODAK PROFESSIONAL InkJet Photo Contest, 1633 Broadway, 43rd Floor, New York, New York 10019.You may submit a maximum of three entries per mailing address, however, each entry must be mailed separately and each photograph must be different. Entries containing multiple entries will be considered ineligible. Entries postmarked after September 30, 2006 will not be eligible.
- PHOTO GUIDELINES:No alteration or manipulation of photographs is permitted.All prints must be no smaller than 3 ½" x 3 ½" and no larger than 11" x 14". If you submit a print from a digital file, indicate the actual size of the original digital file. Disks, tapes, or CD-ROMs will not be accepted. We suggest you retain the original film and any unique photographs, and submit only replaceable items.All entries and contest materials become property of the Sponsors, and none will be acknowledged or returned.All entries, with the exception of the winning photos, will be destroyed.Proof of mailing or submitting is not proof of delivery.
- For all Entries: Entries must not be inappropriate, indecent or obscene, as determined by Sponsors in its sole discretion.Proof of submission or sending is not proof of receipt by Sponsors.Sponsors shall have the right to edit, adapt and publish any or all of the descriptions and/or photos submitted, and may use them in any media in association with the Contest without attribution or compensation to the Contestant, his or her successors or assigns, or any other entity.Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible, illegible, or misdirected requests, which are void.
LIMIT: Three photograph submissions per person during the Contest Period. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different, identities, registrations and logins, or any other methods will void that participant’s entries and that participant may be disqualified.
Entries must be submitted by the original photographer. Do not submit a photo taken by someone other than yourself. You must be the sole owner of the copyright of any image submitted. Your submission of the photo is your guarantee that you are the author and copyright holder of the photo. In addition, by entering, Contestants represent and warrant that the entries that they submit (i) do not infringe any other person’s or entity’s rights; and (ii) have not been submitted previously in a Contest of any kind.
Photographers retain the copyright to their photographs, and all rights thereto, except as follows. By entering the Contest, photographers agree to have their submitted photograph displayed without any fee or other form of compensation, and agree that Sponsors may make, retain and display copies of the photograph for archival purposes. Photos will be credited to the photographer named in the entry form. In the event that ownership of any photograph submitted is contested in any manner, Sponsors may disqualify that photograph and discontinue use of the photograph.
- JUDGING FORWINNERS : Winners will be chosen based on the following criteria: (33%) originality of photograph, (33%) creativity, and (34%) photographic quality. Qualified independent judges selected by Sponsors, whose decisions regarding the Contest and related matters are final, will choose the Contest winners. The Judges will determine one Grand Prize winner, one winner for the First Place Prize and one winner for the Second Place Prize. Winners will be notified by registered mail on or about October 31, 2006. Winners must comply with all Contest rules as published. In the event of a tie for any prize, the entry that is the most creative will win the prize in the applicable category. Winners, or the parent or legal guardian of such winners if a winner is a minor in his/her state of residence, will be required to sign and return an affidavit of eligibility, and liability/publicity release, where permitted, within 21 days from the date of notification. All winners agree to conduct any and all media interviews related to the Contest if requested and not disparage Sponsors during interviews. Failure to comply with this requirement for any reason, return of prize notification or prize as undeliverable, or if a winner is disqualified for any reason will result in forfeiture. Acceptance of any prize shall constitute and signify the winner’s agreement and consent that Sponsors may use the winner’s name, city, state, likeness, photos and/or prize information in connection with the Contest worldwide, including the internet, without limitation and without further payment or consideration, except where prohibited by law.

For all prizes: All taxes and fees associated with prize receipt and/or use of the prize are the winner’s responsibility. No cash equivalent will be provided and all prizes are non-transferable and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Sponsors reserve the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Prizes will be awarded "as is" with no warranty or guarantee, either express or implied offered by Sponsors. All Prizes will be shipped within 4-6 weeks of the receipt of the winner’s signed affidavit. Total ARV of all prizes: $3085.
- GENERAL RULES:By entering or participating in the Contest, participants agree to be bound by these Official Rules.Sponsors assume no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any entry or other information, or for the failure to capture any such information.Sponsors are not responsible for:(1) any incorrect or inaccurate information, including, but not limited to printing errors whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries. Further, if, for any reason, the Contest is not capable of running as planned for any reason, in the sole opinion of the Sponsors, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the Contest, and select the winner for the Contest, from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsors.
Participants, by participating in this Contest, hereby waive and release, and agree to hold harmless the Sponsors, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of the prize in the Contest, or their participation in the Contest, or their participation in any Contest or prize related activity. Winner also further acknowledges that Sponsors, their affiliates, subsidiaries, employees, officers, directors, and promotions and advertising agencies have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or these Contest including but not limited to quality, condition or fitness for a particular purpose. Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of the State of New York, without respect to any conflict of law issues, and entrant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of New York (Southern District) or the appropriate State Court located in New York County, New York.
- Personal Information:Any personal information collected online through the Contest is subject to Sponsors’ privacy statements set forth at http://www.kodak.comand a http://www.popphoto.com. Any personal information handled by an agency or vendor of Sponsors, will be done solely on their behalf and all such information shall be handled exclusively in conformance with Sponsors’ privacy statement.

Requests for rules must be postmarked by August 15, 2006.Requests for winner’s lists must be postmarked by December 1, 2006.Residents of Vermont do not need to include return postage.
